Purpose of the data processing
Purpose of the data processing is the initiation of employment on the basis of Art. 6 (1) (b), Art. 88 (1) GDPR in conjunction with Section 26 of the German Federal Data Protection Act (BDSG). For inclusion in the talent pool, your consent is required in accordance with Art. 6 (1) (a) GDPR.
Categories of recipients
For recruitment and the management of applicant data, we use the software SmartRecruiters provided by SmartRecruiters GmbH, Wilhelmstraße 118, 10963 Berlin. SmartRecruiters GmbH acts as a processor under a Data Processing Agreement pursuant to Art. 28 GDPR concluded with Senior plc. Senior Flexonics GmbH uses SmartRecruiters on the basis of this Agreement.
The processing of applicant data is carried out jointly by Senior Flexonics GmbH and Senior plc under a Joint Controller Agreement pursuant to Art. 26 GDPR. This agreement defines how the respective tasks and responsibilities in the processing of personal data are structured and which party fulfils which data protection obligations. It also sets out how an adequate level of security and the rights of data subjects are ensured.
If you wish to participate in the group-wide talent pool, your data will be transferred to other companies within the Senior Group that are also bound by the Joint Controller Agreement. Since we use IT service providers who are separately obliged to maintain confidentiality and comply with data protection requirements, access to personal data in this context cannot be completely excluded. Categories of recipients outside company and HR management include service providers for hosting, support, and operation of this website, as well as external consultants. Disclosure to public authorities only takes place where overriding legal provisions require it.
The transfer of data to third countries for processing purposes takes place solely under the conditions of Art. 44 et seq. GDPR.
Storage period and deletion of data
Your data will be stored for the duration of the application process; once you start working for us, your application data will be stored for the duration of your employment. In case the decision about your application results in a rejection, we shall retain your data on legal basis for further 6 months and subsequently delete it; In the case of unsolicited applications or participation in the talent pool, we will retain your data until you withdraw your consent or for a maximum of two years.
Your right to information, rectification, erasure, object and data portability
You may exercise your right to information, rectification and erasure of data at any time. To do so, please contact us using the contact details provided above. If you request data erasure but we are still legally obliged to retain it, access to your data will be restricted (blocked). The same applies to an objection. You can exercise your right to data portability, provided that the technical means are available at the recipient and at our company.
Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority at any time.
Provision obligation
Without providing correct data, the execution of the application process may not be possible. The result may be that your application cannot be considered in the application process.
